Welcome to Beanery ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website, services, and marketplace platform located at [https://www.beanery.net] (the "Site"). By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Site.

1. Overview

Beanery is an online marketplace that connects coffee consumers with independent coffee roasters. We provide a platform for roasters to list their products and for customers to discover, explore, and purchase beans. While we facilitate transactions, we do not manufacture, store, or ship the coffee products listed on our platform.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Site. By using the Site, you represent and warrant that you meet these requirements.

3. User Accounts

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information.

4. Marketplace Transactions

  • All purchases on the Site are made between consumers and third-party sellers (roasters), with Beanery acting as a facilitator of the transaction.
  • Beanery collects payment from the consumer at the time of purchase and subsequently remits payment to the applicable roaster, less any applicable service or platform fees.
  • By using the Site, you authorize Beanery to act as the limited payments agent for the seller to collect payments on their behalf and to disburse such payments accordingly.
  • Title and risk of loss for products purchased through the Site pass directly from the roaster to the consumer upon shipment. Beanery does not take title to any products sold through the marketplace.
  • Roasters are solely responsible for fulfilling orders, managing shipping, and complying with all applicable regulations related to the sale and distribution of their products.

5. Payments

  • All payments are processed securely through our integrated payment service providers.
  • Beanery is responsible for collecting payment from customers and initiating payout to roasters in accordance with our seller agreement.
  • By purchasing a product through Beanery, you agree to pay all listed prices and applicable taxes and authorize Beanery to charge your chosen payment method.
  • Sellers agree to receive payments through the Beanery platform and acknowledge Beanery’s role as their payment collection agent.

6. Refunds and Returns

Each seller may have their own return and refund policy. Please review the seller’s policies before purchasing. Beanery does not issue refunds directly but may assist in resolving disputes at our sole discretion.

If a refund is approved, Beanery will process it on behalf of the seller. Refunds will be returned to the original payment method, subject to the processing timelines of your bank or card issuer.

7. Prohibited Activities

You agree not to:

  • Violate any laws, regulations, or third-party rights;
  • Post false, misleading, or deceptive content;
  • Attempt to gain unauthorized access to the Site;
  • Interfere with the operation of the Site or the experiences of other users;
  • Use the Site to promote or sell products unrelated to coffee or otherwise violate marketplace guidelines.

8. Intellectual Property

All content on the Site, including logos, text, images, and software, is owned or licensed by Beanery and protected by intellectual property laws. You may not reproduce, distribute, or use any content without express written permission.

9. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, if we determine that you have violated these Terms or engaged in behavior that harms the marketplace or its users.

10. Disclaimers

The Site and its services are provided “as is” and “as available.” Beanery does not guarantee the accuracy, quality, legality, or safety of products listed or sold by roasters. We do not endorse or warrant any particular seller or product.

11. Limitation of Liability

To the fullest extent permitted by law, Beanery shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or the products purchased through the platform.

12. Indemnification

You agree to indemnify and hold harmless Beanery and its officers, directors, employees, and agents from any claims, losses, or damages, including legal fees, resulting from your use of the Site, your violation of these Terms, or your interaction with other users.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top of this page. Your continued use of the Site after any updates constitutes acceptance of the revised Terms.

14. Governing Law
